Florida couple found guilty of having sex on beach, forced to register as sex offenders

BRADENTON, FL - Who knew having sex on a beach could score you a spot on the registered sex offenders list?

A couple in Florida is being required to, yes, register as sex offenders after a jury found them guilty of having sex in front of a kid on Bradenton Beach, just south of Tampa.

"Very surprised someone would be that bold on public beach with people around," said Eric Hill with Bradenton Beach Police.

Video allegedly shows 40-year-old Jose Caballero and 20-year-old Elissa Alvarez 'doin' the dirty' last summer.

A witness says a 3-year-old saw the incident, not ideal, obviously. However illegal is illegal. The fact that the child was a witness is apparently why they will have to register as sex offenders.

The couple denies the lewd act and claims they were cuddling and wrestling.

Prosecutors are going soft on Alvarez since she has no previous criminal history, but they're looking to give Caballero some hard time minus the sand and crystal waters; 15 years in jail.

Why? State attorney Anthony Dafonseca says it's because less than three years ago caballero was released from prison for another felony.

Seems like instead of living and learning.  Caballero is living and loving, publicly.
