HOUSTON -  Telling nothing but the truth in court is in jeopardy with an expert DWI toxicology witness in some hot water.

Dr. Fessessework Guale, a toxicology operations manager at Harris County Institute of Forensic Sciences, is being accused of lying on the stand about her education.

"She has flat out stated and testified under oath, I have a Masters Degree in Toxicology, and that is not the truth," said defense attorney Tyler Flood, President of Harris County Criminal Lawyers Association.

Court documents show that Guale claimed to have a Master's of Science Degree in toxicology but it is really in physiological sciences, and her toxicology training only relates to animals.

"She has lied to the crime lab that she works at, she's lied to prosecutors, and she's lied to judges," said Flood.

The HCCLA seeks criminal action against Guale.
