PHILADELPHIA, PA – A judge in Philadelphia has declared a mistrial after a witness lost his prosthetic eye while on the stand.

John Huttick, 48, was testifying against Matthew Brunelli, 23, who is accused of aggravated assault. Brunelli allegedly attacked Huttick and stabbed him in the eye, causing him to have his eye surgically removed.

During testimony, Huttick began to cry, which caused his fake eye to pop out into his hand.

The jury was shocked and the judge declared a mistrial stating the incident could generate sympathy for Huttick.

A new trial has been scheduled for March 4.
